1. General conditions


1.1. The purpose of the privacy policy is to provide an individual with information about the purposes and scope of personal data processing, protection, and duration of processing during the receipt and processing of data.


1.2. As part of cooperation with "BIO-STAR" LTD, personal information, including name and surname, telephone number, email address, bank details, and address for delivery of goods may be required from an individual (professional self-employed person, employee, or company representative). The information is necessary to ensure direct cooperation: processing and delivery of the order, and administration of payments. "BIO-STAR" LTD uses personal data in compliance with security standards.

3. Scope of the document


3.1. Personal data is any information about an identified or identifiable natural person – a client (professional self-employed person), an employee or company representative – a business partner.


3.2. The privacy policy is applied to ensure the confidentiality and protection of personal data of individuals – clients (professional self-employed persons), employees or representatives of companies – business partners (including potential, former and current).


3.3. "BIO-STAR" LTD cares about the privacy and protection of the personal data of an individual, respects the right to the lawfulness of processing personal data in accordance with the applicable regulations: the Law on the Processing of Personal Data of Individuals, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals concerning the processing of personal data and on the free movement of such data, as well as other applicable laws and regulations in the field of privacy and data processing.


3.4. The privacy policy applies to the processing of data regardless of the form and in which environment an individual provides data (on the website of "BIO-STAR" LTD (www.bio-star.eu), by e-mail, by phone or in person) and in which enterprise systems or if in printed form they are processed.


4. Purposes of processing personal data


"BIO-STAR" LTD processes personal data for the following purposes:

  • for the provision of services and the sale of goods.
  • for the identification of the client.
  • for the preparation and signing of an agreement and (or) invoice.
  • for the delivery of goods.
  • for the fulfillment of warranty obligations.
  • for customer service.
  • for the review and process of claims.
  • to retain customers, increase loyalty, and measure satisfaction.
  • for the administration of settlements.
  • to ensure the quality of services of "BIO-STAR" LTD.
  • to provide information to government bodies and subjects of operational activities in the cases and in the amount provided for by external regulatory acts.
  • for other specific purposes, about which the person is notified at the time of providing the relevant data to "BIO-STAR" LTD.

5. Processing of personal data


5.1. "BIO-STAR" LTD processes personal data by using the capabilities of modern technologies, taking into account the existing privacy risks and available organizational, financial, and technical resources.


5.2. Personal data may be transferred to trusted business partners who provide specific services, such as resource planning system administrators and security and safety service providers.


6. Categories of recipients of personal data


6.1. "BIO-STAR" LTD does not disclose personal data or any information obtained in the course of cooperation to third parties, except for the following cases:


6.1.1. if the data needs to be transferred to the relevant third party within the framework of the concluded agreement for the implementation of any function necessary for the fulfilment of the agreement or delegated by law (for example, in bank settlements, to the courier service for delivery of the order, to the resource planning system administrator for the purpose of storing and processing data.


6.1.2. in the cases provided for by external regulatory enactments, at the justified request of the relevant persons in the prescribed manner and amount.


6.1.3. in cases stipulated by external regulatory enactments, for the protection of the legitimate interests of "BIO-STAR" LTD, for example, when applying to a court or other state institutions with a claim against a person who has violated these legitimate interests.


7. Duration of storage of personal data


7.1. "BIO-STAR" LTD stores and processes personal data as long as at least one of the following criteria applies:


7.1.1. during the term of the agreement concluded with a specific person.


7.1.2. as long as, in the manner prescribed by external regulatory enactments, "BIO-STAR" LTD or an individual can pursue their legitimate interests (for example, to file objections or bring a claim or conduct legal proceedings in court.


7.1.3. if either party has a legal obligation to store the data.


7.1.4. as long as the consent to the processing of the data of the person concerned is valid in the absence of another legal basis for the processing of the data.


7.2. After the termination of the above circumstances, personal data is archived, deleted or liquidated.


8. Access to personal data and other rights of the personal data subject


8.1. The subject of personal data has the right to receive information provided for by regulatory enactments about the processing of their data.


8.2. In addition, according to regulatory enactments, the subject of personal data has the right to demand from "BIO-STAR" LTD to provide access to their personal data, as well as to demand that such data would be supplemented, corrected or deleted, or restrict their use by a relative person, or object to their processing (including the processing of personal data, carried out based on the lawful (legitimate) interests of LLC “EMIL COMPANY EUROPE.” This right is exercised to the extent that the processing of data is not subject to the obligations of "BIO-STAR" LTD imposed by the current regulatory enactments and carried out in the public interest.


8.3. The personal data subject has the right to submit a request for the exercise of their rights as follows:


8.3.1. in writing in person at the office of "BIO-STAR" LTD upon presentation of an identity document.


8.3.2. by e-mail in the form of a letter signed with a secure electronic signature.


8.4. After receiving a request from the subject of personal data to exercise their rights, "BIO-STAR" LTD certifies the identity of the subject, evaluates the request and executes it in accordance with the regulatory enactments.


8.5. "BIO-STAR" LTD sends a response to the subject of personal data to the contact address indicated by them by registered mail or e-mail, taking into account, if possible, the method of receiving the response specified by the subject.


8.6. "BIO-STAR" LTD ensures the fulfilment of data processing and data protection requirements in accordance with regulatory enactments and in case of receiving objections from the data subject, takes appropriate actions to resolve them. However, if it would not be possible to resolve the disputed situation, the data subject has the right to contact the supervisory authority – the State Data Inspectorate.


9. Communication with the personal data subject


9.1. "BIO-STAR" LTD communicates with the personal data subject using the contact information specified by them (phone number, email address, postal address). "BIO-STAR" LTD communicates in connection with the fulfillment of contractual obligations on the basis of the concluded agreement and (or) issued invoice (for example, coordination of the provision or change of services, information on invoices, etc.).


10. Commercial notices


10.1. To provide the personal data subject with information about current offers and news that might interest them, "BIO-STAR" LTD may use personal data for marketing purposes. The personal data subject has the right at any time to refuse to receive data from advertising messages in one of the following ways:


10.1.1. by using the automatic option provided in the commercial notice to opt out of further receipt of notifications by clicking on the link at the end of the corresponding commercial notice (e-mail).


10.1.2. by sending an email to the address: sale@bio-star.eu.


10.1.3. by calling the office of "BIO-STAR" LTD by phone: +37126400736.


10.2. "BIO-STAR" LTD stops sending commercial notices immediately after processing the respective request of the subject. It can take up to one business day to process the request.


10.3. "BIO-STAR" LTD under no circumstances allows the use of personal data in advertising and when interacting with third parties.


11. Other provisions


11.1. "BIO-STAR" LTD has the right to amend the privacy policy by publishing the current version on the home page of "BIO-STAR" LTD - www.bio-star.eu.


11.2. The website of "BIO-STAR" LTD may use “cookies”. The cookie terms and conditions are attached in the annex and are available here.


11.3. The website of "BIO-STAR" LTD may contain links to websites of third parties, where other rules of use and protection of personal data apply, for which "BIO-STAR" LTD is not responsible.


11.4. This privacy policy is effective as of September 10, 2022.
